We are The BOM Academy (“Company,” “we,” “us,” “our”), a company registered in Georgia, United States, at 2023 Summit Overlook Way, Cumming, GA.

We operate the website https://www.thebomacademy.com (the “Site”), along with any other related products and services that link to these terms (the “Legal Terms”) (together, the “Services”).

These Legal Terms are a binding agreement between you (or the company you work for) and The BOM Academy. They cover how you use our Services. By using our Services, you have read, understood, and agreed to all of these Legal Terms.

IF YOU DO NOT AGREE WITH THESE LEGAL TERMS, YOU MAY NOT USE OUR SERVICES. YOU MUST STOP USING THEM RIGHT AWAY.

We may add extra terms or post other rules from time to time. Those rules become part of these Legal Terms when we post them. We may also change these Legal Terms at any time and for any reason. We will show changes by updating the “Last updated” date at the top. You give up your right to be told about each change. It is your job to check this page now and then. If you keep using the Services after we post new terms, you agree to the new terms.

Our Services are made for parents or guardians to sign up their children. People under 18 may not sign up or use the Services on their own. A parent or guardian must sign up on their child’s behalf.

We suggest you print or save a copy of these Legal Terms.


1. Our Services

The info on our Services is not meant for people in places where it would be against the law. If you use our Services from outside the United States, you do so on your own. You are in charge of following your local laws.

Our Services are not made to follow rules like HIPAA, FISMA, or GLBA. If your use would fall under those laws, you may not use our Services.


2. Intellectual Property Rights

Our Content and Marks

We own or have the rights to all the content on our Services. This includes our code, software, designs, audio, video, text, photos, and graphics (the “Content”). It also includes our trademarks, logos, and service marks (the “Marks”).

Our Content and Marks are protected by copyright and trademark laws in the U.S. and around the world.

We give you our Content “as is” for your personal, non-business use only.

How You May Use Our Services

If you follow these Legal Terms, we give you a limited license to:

  • Use the Services, and
  • Download or print a copy of any Content for your own personal use only.

You may not copy, sell, license, post, or use any of our Content or Marks for business purposes without our written okay first.

If you want to use our Content or Marks in any other way, please email thebomacademy@gmail.com.

If we ever let you post or share our Content, you must give us credit as the owner. You must keep any copyright notice visible.

If you break our intellectual property rules, your right to use our Services ends right away.

Your Submissions and Contributions

Submissions: If you send us any idea, comment, or feedback (“Submissions”), you give us full rights to use it. We own that Submission and can use it any way we want, for free, with no credit to you.

Contributions: Our Services may let you post photos, comments, reviews, or other content (“Contributions”). Other users may see these. By posting, you give us a worldwide, free, forever license to use, copy, share, change, or sell your Contributions. This includes your name, voice, and image.

You are responsible for what you post. You agree that your Contributions:

  • Are not illegal, hateful, harmful, or false
  • Do not break anyone else’s rights
  • Are your own work or you have permission to use them
  • Are not confidential

We may remove or change your Contributions any time if we think they break these terms.


3. User Representations

By using the Services, you state and promise that:

  1. All info you give us is true, current, and complete.
  2. You will keep your info up to date.
  3. You have the legal right to agree to these terms.
  4. You are not a minor where you live.
  5. You will not use bots or scripts to access the Services.
  6. You will not use the Services for any illegal reason.
  7. Your use will not break any law.

If you give us false info, we may suspend or close your account.


4. User Registration

You may need to sign up to use the Services. Keep your password secret. You are in charge of anything done with your account. We may change a username if we think it is wrong or rude.


5. Purchases and Payment

We take these forms of payment:

  • Mastercard
  • Visa

You agree to give us current and correct payment info. You agree to keep your info up to date so we can take payments. We may add sales tax to your purchase as the law requires. We can change prices at any time. All payments are in U.S. dollars.

You agree to pay all charges. You let us charge your card for any orders you place. We may fix pricing mistakes even after we have charged you.

We may refuse any order. We may limit how many sessions one person or family can buy. We may cancel orders that look like they are from resellers.


6. Subscriptions

Billing and Renewal

Your subscription will keep going and renew on its own unless you cancel. You agree to let us charge your card every month without asking you each time. The billing cycle is monthly.

Cancellation

You can cancel any time by reaching out to us. Your cancellation will start at the end of your current paid month. If you have questions, please email thebomacademy@gmail.com.

Fee Changes

We may change subscription fees from time to time. We will tell you about any price change as the law requires.


7. Refund Policy

All sales are final. We do not give refunds.


8. Reschedules and Cancellations

You must reschedule or cancel a session at least 24 hours before it starts. If you do not, you will still be charged.

You can reschedule each session only one time.

9. Text Messages (SMS and MMS)

This section is very important. Please read it with care.

Our SMS Program

The BOM Academy runs a text message program for our customers. We send texts to help you and your child stay on top of training and to share news about our school.

What Texts We Send

If you give us your phone number and say yes to texts, we may send you:

  • Session reminders and confirmations
  • Schedule changes
  • Replies to your questions
  • Payment reminders
  • News about classes, camps, and special events

Our messages will come from a number we have set up just for our texts. The first text will say it is from The BOM Academy.

How You Sign Up for Texts (Opt In)

You can sign up for texts when you fill out a form on our website. The form will have a check box. The box is not pre-checked. You must check it on your own. The phone number field is optional. You can use our Services even if you do not say yes to texts.

The opt-in box says:

By giving us your mobile phone number and checking this box, you agree to get text messages from The BOM Academy at that number. Text frequency may vary. Message and data rates may apply. Reply HELP for help. Reply STOP to stop. See our Privacy Policy and Terms.

When you check the box, you state and agree that:

  • The phone number you gave us is yours, or you have permission to use it.
  • You agree to get texts from The BOM Academy at that number.
  • You have read and agree to these Terms and our Privacy Policy.

How Often We Send Texts

Text frequency may vary. Most people get a few texts each month. Busy weeks like school breaks or camp weeks may have more.

Message and Data Rates

Standard message and data rates may apply. Your phone company may charge you for each text we send or that you send. We are not responsible for these charges. Please check your phone plan.

How to Stop Texts (Opt Out)

You can stop our texts at any time. Just reply with one of these words to any text we send:

  • STOP

After you reply, we will send one last text to confirm you are out. You will not get any more texts from that program.

If you opt out of marketing texts, we may still send you transactional texts. Transactional texts are the ones you need to use our Services, like session confirmations or payment receipts. To stop those too, please contact us.

How to Get Help

If you need help with our texts, reply HELP to any text we send. You can also call us at (470) 448-6867 or email thebomacademy@gmail.com. We will respond as soon as we can.

Your Mobile Info Is Safe

Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. All other categories exclude text messaging originator opt-in data and consent. This information will not be shared with any third parties.

In plain words:

  • We will not sell your mobile phone number.
  • We will not rent your mobile phone number.
  • We will not give your phone number to any other company so they can send you ads.
  • We will not share your text opt-in records with anyone outside our company.

We may share your phone number only with our service providers who help us send the texts. They cannot use it for their own ads or share it with anyone else.

When you say yes to texts from The BOM Academy, you say yes to texts from us only. We do not pass your consent to other businesses. If you ever want texts from a partner, you would need to say yes to that partner on their own form.

Delivery Is Not Guaranteed

The BOM Academy does not promise that any text will arrive on time. Delivery depends on your phone carrier. We are not responsible for delays, missed texts, or any problems with delivery.

TCPA, CTIA, and Carrier Rules

We follow the rules of:

  • The Telephone Consumer Protection Act (TCPA)
  • The CAN-SPAM Act
  • The CTIA Messaging Principles and Best Practices
  • All other federal and state laws about business messages

Our brand and campaigns are registered with The Campaign Registry (TCR). This group checks that businesses follow U.S. text messaging rules.


10. Phone Calls

By giving us your phone number, you agree to let us call you about your account, your sessions, billing, and other service needs. We may use automatic dialing tools where the law allows.

11. Email Communications

By giving us your email, you agree to get emails from us about:

  • Your account
  • Your sessions
  • Billing
  • Updates about our school
  • News, promotions, and special offers

Every marketing email has an unsubscribe link at the bottom. You can opt out of marketing emails any time by clicking that link. We may still send you service emails you need to use our Services.


12. Service Providers We Use to Send Messages

We use trusted third-party service providers to send our texts, emails, and other messages on our behalf. These providers act as our vendors. They follow these rules:

  • They follow A2P 10DLC rules.
  • They keep your info safe with strong security tools.
  • They do not use your info for their own ads.
  • They only use your info to help us send our messages.
  • They handle STOP and HELP keywords for us, so opt-outs work right away.
  • They are bound by confidentiality and data protection duties.

You agree that we may share your phone number and email with these service providers only for the purpose of sending you our messages.


13. Accuracy of Your Contact Info

You state that the phone number and email you give us are real and that you have the right to use them. You agree to tell us right away if your number or email changes.

If we send messages to a number or email you gave us, and that number or email later goes to someone else, you must let us know. We are not responsible for messages that go to the wrong person if you did not tell us about the change.


14. Prohibited Activities

You may not use our Services for any reason other than what we make them for. You may not use our Services for business unless we say it is okay.

You agree not to:

  • Pull data from the Services to build a list or database without our written okay
  • Trick, defraud, or mislead us or other users
  • Get around or disable any security feature
  • Harm, badmouth, or hurt our reputation
  • Use info from our Services to harass or abuse anyone
  • Misuse our support team or file false complaints
  • Use the Services in a way that breaks the law
  • Frame or link to our Services without permission
  • Upload viruses or harmful files
  • Use bots, spiders, or scrapers to access the Services
  • Remove our copyright or trademark notices
  • Pretend to be another user
  • Upload tracking pixels or spyware
  • Disrupt our networks
  • Harass our staff
  • Bypass our access controls
  • Copy our software code
  • Reverse engineer our software
  • Use buying agents to make purchases
  • Collect emails or numbers to send spam
  • Compete with us by using our Services
  • Sell or transfer your account

If you break these rules, we may end your account and take legal action.


15. User Generated Contributions

The Services may let you chat, comment, post, or share content (“Contributions”). Other users may see your Contributions. By posting, you state and promise that:

  1. Your Contributions do not break anyone’s copyright, trademark, patent, or other rights.
  2. You own your Contributions or you have permission to share them.
  3. You have written permission from every person who shows up in your Contributions.
  4. Your Contributions are true and not misleading.
  5. Your Contributions are not spam, chain letters, or scams.
  6. Your Contributions are not obscene, violent, or threatening.
  7. Your Contributions do not mock or abuse anyone.
  8. Your Contributions do not harass or threaten others.
  9. Your Contributions follow all laws.
  10. Your Contributions do not break anyone’s privacy.
  11. Your Contributions do not include any material that harms minors.
  12. Your Contributions do not include hateful remarks based on race, gender, or any protected group.
  13. Your Contributions do not break any of these Legal Terms.

If you break these rules, we may end or suspend your account.


16. Contribution License

By posting Contributions on the Services, you give us an unlimited, forever, free, worldwide license to use, copy, share, change, sell, or display your Contributions in any way. This includes using your name, voice, and image.

You waive any moral rights you may have in your Contributions. You promise no one else has claimed moral rights in them.

We do not claim to own your Contributions. You still own them. But you give us the rights listed above.

We can edit, move, or delete any Contribution at any time without telling you.


17. Third-Party Websites and Content

Our Services may have links to other websites or content from outside our company. We do not check these for safety or accuracy. We are not responsible for them.

If you click a link and leave our Services, these Legal Terms no longer apply. Please read the rules of any other website you visit. Any purchase you make on another site is between you and them. We are not responsible for those purchases.


18. Services Management

We have the right (but not the duty) to:

  1. Watch the Services for rule breaks.
  2. Take legal action against anyone who breaks our rules or the law.
  3. Refuse, limit, or remove any Contribution at our choice.
  4. Remove files that are too big or that hurt our systems.
  5. Manage the Services to protect our rights and keep things running.

19. Privacy Policy

We care about your privacy. By using our Services, you agree to our Privacy Policy. The Privacy Policy is part of these Legal Terms.

Our Services are hosted in the United States. If you visit from another country, your data will go to the U.S. By using our Services, you agree to let us send your data to the U.S.

20. Term and Termination

These Legal Terms stay in effect as long as you use our Services.

WE MAY DENY ANY PERSON ACCESS TO THE SERVICES FOR ANY REASON OR FOR NO REASON, AT OUR SOLE CHOICE, WITHOUT NOTICE. WE MAY DELETE YOUR ACCOUNT OR ANY CONTENT YOU POSTED AT ANY TIME, AT OUR SOLE CHOICE, WITHOUT WARNING.

If we close your account, you may not sign up again under any name. We may also take legal action against you.


21. Modifications and Interruptions

We may change, update, or remove parts of our Services at any time for any reason. We do not have to update info on the Services. We may stop offering all or part of the Services at any time. We are not liable for any changes or stops.

We cannot promise that the Services will always be up and running. There may be tech problems or maintenance breaks. We are not liable for any harm or loss caused by downtime.


22. Governing Law

These Legal Terms and your use of the Services are governed by Georgia state law. We do not apply conflict of law rules.


23. Dispute Resolution

Informal Talks First

If you have a dispute with us (a “Dispute”), you and we agree to try to work it out by talking for at least 30 days first. Talks start when one side sends written notice to the other.

Binding Arbitration

If we cannot work it out by talking, the Dispute will go to binding arbitration. YOU UNDERSTAND THAT WITHOUT THIS PROVISION, YOU WOULD HAVE THE RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL.

The arbitration will follow the rules of the American Arbitration Association (AAA). Where it fits, the AAA Consumer Rules will also apply. You can find these rules on the AAA website.

Your arbitration fees will follow the AAA Consumer Rules. The arbitration may be in person, on paper, by phone, or online. The arbitrator will write a decision. The arbitrator must follow the law. The arbitration will be in Forsyth County, Georgia.

If for any reason a Dispute goes to court, it must be filed in the state or federal courts in Forsyth County, Georgia. You agree that those courts have jurisdiction over you. We do not apply the U.N. Convention on Contracts for the International Sale of Goods or the Uniform Computer Information Transaction Act (UCITA).

You must start any Dispute within one (1) year of when it happened. After that, you give up the right to bring it.

No Class Actions

Each side agrees that arbitration will cover only the dispute between you and us alone. There will be no class actions or group arbitrations.

Exceptions

These rules do not apply to:

  1. Any Dispute about our intellectual property rights.
  2. Any Dispute about theft, piracy, privacy invasion, or wrong use.
  3. Any claim for an injunction (a court order to stop something).

These Disputes can go to court.


24. Corrections

Our Services may have typos, mistakes, or missing info, like wrong prices or descriptions. We may fix these any time without telling you.


25. Disclaimer

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SERVICES IS AT YOUR OWN RISK. TO THE FULL EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE MAKE NO PROMISES ABOUT THE ACCURACY OR COMPLETENESS OF THE CONTENT ON OUR SERVICES OR ON ANY LINKED WEBSITES. WE TAKE NO RESPONSIBILITY FOR:

  1. ERRORS OR MISTAKES IN CONTENT
  2. PERSONAL INJURY OR PROPERTY DAMAGE FROM USE OF THE SERVICES
  3. UNAUTHORIZED ACCESS TO YOUR INFO
  4. ANY BREAK IN OR STOP IN SERVICE
  5. VIRUSES OR HARMFUL CODE SENT BY A THIRD PARTY
  6. ANY LOSS OR DAMAGE FROM CONTENT POSTED OR SHARED ON THE SERVICES

WE DO NOT ENDORSE OR GUARANTEE ANY PRODUCT OR SERVICE ADVERTISED BY A THIRD PARTY. AS WITH ANY PURCHASE, USE YOUR BEST JUDGMENT.


26. Limitations of Liability

IN NO EVENT WILL THE BOM ACADEMY OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES. THIS INCLUDES LOST PROFITS, LOST DATA, OR OTHER DAMAGES FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN WARNED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM WILL BE LIMITED TO THE LESSER OF: (A) THE AMOUNT YOU PAID US IN THE SIX (6) MONTHS BEFORE THE CLAIM, OR (B) $25,000 USD.

SOME U.S. STATES AND OTHER COUNTRIES DO NOT ALLOW LIMITS ON IMPLIED WARRANTIES OR ON CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE LIMITS MAY NOT APPLY, AND YOU MAY HAVE EXTRA RIGHTS.


27. Indemnification

You agree to defend, indemnify, and hold us harmless. This includes our affiliates, officers, agents, partners, and employees. You will protect us from any loss, damage, liability, claim, or demand, including reasonable attorney fees, that comes from:

  1. Your Contributions
  2. Your use of the Services
  3. Your breach of these Legal Terms
  4. Any breach of your promises in these terms
  5. Your harm to another user
  6. Your violation of someone else’s rights

We may take over the defense of any claim, at your expense. You agree to help us with the defense. We will try to tell you about any claim we know about.


28. User Data

We keep certain data from your use of the Services to help us run our business. We do regular backups. But you are in charge of your own data. We are not liable for any lost or corrupted data. You give up any right to sue us for lost or corrupted data.


29. Electronic Communications, Transactions, and Signatures

Visiting our Services, sending us email, and filling out forms count as electronic communications. You agree that we may send you notices and agreements by email or through the Services. These count as legal writing.

YOU AGREE TO USE ELECTRONIC SIGNATURES, CONTRACTS, AND RECORDS. YOU AGREE TO GET NOTICES AND POLICIES BY ELECTRONIC MEANS. You give up any right to require paper signatures or paper records.


30. California Users and Residents

If you live in California and we cannot resolve your complaint, you can contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs:

31. Miscellaneous

These Legal Terms, along with any policies we post, are the full agreement between you and us.

If we fail to enforce any part of these terms, that does not mean we give up that right.

These Legal Terms apply to the fullest extent the law allows.

We may transfer our rights and duties to another company at any time.

We are not liable for delays or failures from causes beyond our control.

If any part of these terms is found to be unlawful, that part will be cut out. The rest of the terms will still apply.

We are not partners, joint ventures, or employees with you because of these terms.

You agree that these terms will not be read against us just because we wrote them.

You give up any defenses based on the fact that these terms are electronic.

The BOM Academy  Participation  Agreement

Every parent or guardian must sign and agree to this when they sign their child up for a BOM Academy program.

Part 1: Acknowledgment and Assumption of Risk

I, the parent or legal guardian, agree that my child’s part in soccer activities has risks. These include physical injury, emotional injury, and damage to property. These risks are part of the sport and cannot be fully removed.

I know that the kinds of injuries that may happen include, but are not limited to:

  • Sprains and strains
  • Broken bones
  • Bruises and cuts
  • Concussions
  • In rare cases, paralysis or death

I know that my child’s part in all academy activities is fully voluntary. This includes practices, games, tournaments, travel, and other events. After thinking about these risks, I agree to let my child take part. I knowingly accept all of these risks on my child’s behalf.

Part 2: Waiver and Release of Liability

In return for my child taking part, I release The BOM Academy and its team (“Releasees”) from any claims, damages, or liability for injuries, illness, or losses during the activity. This release covers injuries from the sport’s normal risks or the ordinary negligence of the Releasees.

Part 3: Indemnification Agreement

I agree to protect the Releasees from any costs, including attorney fees, from claims made by or for my child related to participation. This is true even if the claims arise from the Releasees’ negligence.

I let academy staff get medical care for my child in an emergency. This includes first aid and professional medical care. I am responsible for these costs.

Part 5: Photo and Likeness Release

I let the academy use photos, videos, and audio of my child for promotion. No payment is owed to me for this use.

Part 6: Reschedules and Cancellations

I know that reschedules and cancellations must be made at least 24 hours before the session. If not, I will be charged. Each session can be rescheduled only one time.

Part 7: Parent or Guardian Certification

I confirm my child is healthy enough for soccer training. I will tell the coach about any medical conditions that may affect my child during training.
